Does Caldwell County require a building permit for a barndominium?

Caldwell County requires a Residential Construction Permit for a new home outside city limits, under the Development Ordinance that governs the unincorporated county. It is not a building code permit and the county does not inspect framing or electrical work. What the county reviews is the paperwork around the lot: the recorded plat or a metes and bounds survey, the deed, tax certificates showing current taxes paid, a sketch of the proposed structure, the approved 911 address, and the approved county septic permit. The parcel itself has to be an original tract, a legally platted lot, or a tract exempt from platting, or the permit does not issue. A home inside or within 300 feet of a floodplain must have its first finished floor at least two feet above the adjoining base flood elevation, with an elevation certificate.

What does blackland clay do to a barndominium slab here?

The soil that makes this county good farmland is the soil that makes foundations an engineering question. Houston Black clay formed in clayey residuum weathered from calcareous mudstone of Upper Cretaceous age, on dissected plains, ridges and plains at mostly 1 to 3 percent slopes. When it dries it cracks 0.5 to 4 inches wide from the surface down 12 inches or more. When it takes water back on it closes and swells. That is seasonal, it repeats, and it works in both directions.

At the west end of the chain the ground is a granite batholith, the major structural feature of central Texas, and between there and here it is limestone plateau with shallow soils, stony hills and steep canyons. Those are rock questions. Caldwell's is a clay question, and clay is the one that moves. The county is also not one soil: on the post oak side the surface can read as sand or sandy loam while the clay pan sits a few feet under it, so a hand test at the gate tells you about the gate. The sample that decides the foundation is the one taken at depth, where the building goes.

What order do the Caldwell County papers have to come in?

Two things gate everything else, and both are about the parcel rather than the building: its platting status and its tax standing. Settle both before you spend money on plans or a slab design, because neither is fixable in a week and neither improves by waiting. A handshake split off a family place is one way this fails. An unpaid year on an inherited tract is the other.

Then work the dependency order, because it runs backwards from the way most people plan a build. The 911 address comes before the septic application, and the approved septic permit is one of the documents the construction permit needs, so septic is the long pole rather than a detail for later. The septic permitting authority has 30 days from receipt to approve or deny the planning materials and the application, with a written explanation on a denial and an appeal to its supervisory body. That is the one clock you can schedule around. Ask Development Services how long the construction permit review itself takes, because that one is not published alongside it.

Several documents come from outside the county, so start them early: the survey, the deed and recorded plat, the tax certificates and the sketch of the proposed structure. Call Development Services once, before you order any of it, and ask what form each one has to be in. Certified copy or plain copy, how recent a tax certificate they will accept, and how detailed the structure sketch has to be are the three answers that save a second trip. What does the San Marcos River or Plum Creek mean for your lot?

There is no lake in this county and no Edwards Aquifer program, so the water questions here are river and creek questions, and they get settled on a map rather than by eye. The FEMA Flood Map Service Center is the official public source for flood hazard information produced for the National Flood Insurance Program, searchable by address, place name or coordinates. Check the parcel there before you make an offer. Flat ground and a dry season are not evidence.

The elevation certificate is the document that follows, and it is an ordered item with a lead time rather than a form you fill in: land surveyors, architects and engineers authorized by law are who certify it. It does three jobs. It sets the flood insurance premium rate, it documents compliance with the local floodplain rules, and it supports a map amendment or revision request if you believe the mapping is wrong on your parcel. In this county the floodplain administrator sits in the same department as the septic program, so the flood question and the septic question can be asked in a single call.

The Edwards Aquifer Protection Program covers eight named Texas counties and Caldwell is not one of them, so the water pollution abatement plan and the contributing zone plan, both of which have to be approved before construction starts where they apply, never come up on your lot. Which rules apply if the lot is inside a city?

A city line changes the build more than the county line does here. Lockhart requires a permit for most construction that physically changes or adds a structure, and construction of a new dwelling is first on its list. The city has adopted the 2018 International Residential Code by Ordinance 2021-39, replacing the 2015 edition. So the same building answers to a published code year and a city review inside the limits, and to your contract alone outside them. In Lockhart's extraterritorial jurisdiction the city's subdivision and signage regulations apply and the full city code does not, which means a lot there is platted under city rules and built under the county's paperwork review.

Septic moves with the city line too. The county is the state's authorized agent for the unincorporated county, and four cities are separately authorized inside their own limits: Mustang Ridge, San Marcos, Uhland and Niederwald. Delegation to a municipality stops at the incorporated area, so a tract just outside one of those four is a county application. The Lower Colorado River Authority is not an authorized agent in this county at all, which is a real difference from the lake counties at the west end of the chain, where LCRA runs the septic program inside its zones.

Confirm which jurisdiction your parcel actually sits in before you fill anything out. A mailing address is not a jurisdiction. With four separate city septic programs and a city ETJ in play, settle the boundary question with the county before you order a survey or a septic design. Bastrop and Travis sit next along the chain and answer the same question differently again: both require a county development permit for all development and three inspections contracted by the builder, where Caldwell requires no inspection of the structure at all.

Nobody inspects the structure out here, so who is actually licensed?

Texas does not require a state license to work as a general contractor, and the Texas Residential Construction Commission was abolished with its enabling Act expiring on September 1, 2009. Local city or county requirements may still apply, and inside Lockhart's limits the city permit and code review is one of them. Outside a city here, the trade licenses below are the only credential anyone standing on your site holds by law. That is why every builder on this site is described as independent, never as licensed. There is no license to hold.

The state does license the trades, and those licenses are public. Plumbers are licensed through the Texas State Board of Plumbing Examiners. Electricians are licensed through TDLR, and non-exempt electrical work has to be done through a licensed electrical contractor. Anyone operating as an on-site sewage facility installer, apprentice, maintenance provider or maintenance technician has to be licensed or registered by TCEQ, with Installer I covering standard systems and Installer II covering all system types.

There is also a version of inspection you can buy, and in a county that inspects nothing it is worth knowing the shape of it. Texas law makes a set of county residential building code standards available, but only to counties that first adopt a resolution or order opting in and that meet the border or population condition, so it is not automatic and not universal. Where a county has opted in, new residential construction in the unincorporated area follows the International Residential Code as published May 1, 2008 or the version in force in that county seat, at least three inspections are required (foundation before concrete, framing and mechanical before drywall, and on completion), and the builder, not the county, contracts a qualified inspector for each. Whatever this county's own status, that is a template you can write into your contract: name the code year, name the three inspection points, and name who pays the inspector. Barndominium construction goes smoothly when the standard is written down before the first pour and badly when it is assumed.

What is the ground like around Lockhart?

Two landscapes meet inside this county and they behave differently under a slab. The blackland side is deep black clay formed in clayey residuum weathered from calcareous mudstone, sitting on dissected plains and ridges at mostly 1 to 3 percent slopes. The post oak savannah side is oak woodland patches broken by grassland, with sands and sandy loams on the uplands and clay or clay loams in the bottoms. The catch on the sandy side is that a dense clay pan almost impervious to water underlies all of those soil types at only a few feet deep. A lot can hand-auger sandy and friendly at the surface and still be a clay lot where it counts.

Near-level ground is easy to build a pad on and slow to drain. On 1 to 3 percent slopes water leaves at the pace the ground allows, and where the clay pan sits a few feet down it does not soak away. So drainage is not a landscaping afterthought here, it is part of the foundation decision. Ask your independent builder to show you on paper where roof water, driveway water and sheet flow off the surrounding grade go once the pad is up, and where the septic drainfield sits relative to all three. On a tract that has been in row crops or pasture, old field contours and turn rows can push water in a direction the contour lines do not suggest.

Deep clay on near-level ground changes what a build budget is made of here. The two questions that set a price are what the slab design assumes about seasonal soil movement, and where water ends up on ground that barely falls. Neither is answered by a square-foot figure, and both are answered on your specific lot rather than in a brochure. Get them settled before a number means anything. What does a barndominium lot in Caldwell County run into first?

  • A tract split off a family place by handshake, never platted and never qualified as exempt, has no route forward until the platting status is fixed, and fixing it is a survey-and-record job, not a form. Get the answer from Development Services in writing before you spend anything on plans or a slab design.

  • Tax certificates are pulled from the taxing office, not from the county, and an unpaid year anywhere on a recently split or inherited tract surfaces at exactly the wrong moment. Pull them at the start of the process rather than at submission.

  • Sandy-looking uplands in the post oak country sit over a clay pan almost impervious to water a few feet down. A shallow hand test at the driveway proves nothing about what is under the building footprint.

  • Get a soil investigation on the actual building footprint before you accept a foundation price. A slab detail that arrives with a building package is a standard drawing, and on soil that cracks 0.5 to 4 inches wide and then closes again, that drawing is the decision.

Does Caldwell County inspect the house?

My tract is over 10 acres. Do I still need a septic permit?
Yes.
