Does Bastrop County require a building permit for a barndominium?

A Bastrop County development permit is required for all development in the unincorporated county, and that includes a single-family home, a manufactured home, an RV and a tiny home. The permit class is set by the parcel’s relationship to the mapped 100-year floodplain, so floodplain review is built into the development permit rather than being a separate one. Where there is no public sewer the development permit and the septic permit are applied for at the same time. The county issues no building permits and no certificates of occupancy and performs no building inspections itself, but its Commissioners Court adopted residential building code standards by resolution on September 14, 2009, so a new house in the unincorporated county must meet the code that resolution brought in, and three inspections are required at the foundation, framing and mechanical, and completion stages, contracted by the builder with a private qualified inspector.

Is your tract inside Houston toad country?

The Houston toad is federally endangered, listed on October 13, 1970 under the Endangered Species Conservation Act of 1969. Critical habitat for it was designated in portions of Bastrop and Burleson counties on January 31, 1978. Range-wide audio surveys from 2006 to 2011 detected the toad in only nine counties, and Bastrop is one of them. What it needs is exactly what this county has: the seasonally moist sandy soils of the Lost Pines.

That is why the species question reads differently here than at the other end of the chain. On the Edwards Plateau, where shallow soils sit over limestone, the listed species in the conversation is the golden-cheeked warbler, which nests and breeds only in mixed Ashe juniper and deciduous woodlands. Here it is a toad, and it turns on sandy ground that stays moist, which is the same ground you want to build on.

On a specific lot it comes down to a Lost Pines Habitat Conservation Plan decision where the tract falls inside the covered area. Whether yours does is a question for Bastrop County Development Services and for the U.S. Fish and Wildlife Service. It is not a builder's call and it is not this page's call. What does the 2011 fire mean for a house going up now?

The Bastrop County Complex fire covered 32,400 acres, and 75 percent of that burned at extreme fire intensity. It destroyed 1,660 homes and 36 commercial buildings and burned for 37 days. Those are the recorded numbers, and they are why a pine lot in this county gets a fire conversation that a lot on shallow soil over limestone, at the western end of the chain, does not.

The planning side of it is public. The Texas Wildfire Risk Assessment Portal from Texas A&M Forest Service is a statewide tool supplying wildfire mitigation and prevention planning data, maps, reports and statistics, and the same agency defines the home ignition zones by distance from the structure:

  • Immediate zone: zero to five feet from the house.

  • Intermediate zone: five to 30 feet. Tree crowns at least 18 feet apart, mature canopy no closer than 10 feet to the house.

  • Extended zone: 30 to 100 feet, out to 200 feet where that much land is available. Spacing at least 12 feet at 30 to 60 feet out, at least six feet at 60 to 100 feet out.

The county inspects nothing here, so who does?

The state's county residential building code standards are opt-in. They reach only a county that first adopted a resolution or order, and that also meets the border or population condition in the statute, so nothing about them is automatic. Bastrop's Commissioners Court opted in by resolution in 2009. The same subchapter does not let a county require permission before construction starts and creates no zoning power, so what you are dealing with is a standard the house has to meet, not a gate the county holds.

Who does the inspecting matters more than the count. The builder contracts for the inspections, not the county, and the inspector has to be one of six listed qualified persons. The builder may use one inspector throughout or a different one at each stage, which is worth deciding in the contract rather than discovering at framing. What the state does license is the septic installer, the plumber and the electrician, each with a public license lookup, so on a house the county itself never touches, those lookups are the outside checks actually available to you.

One thing worth settling early is which code edition applies. The statute names the International Residential Code as published May 1, 2008, or the IRC version in force in that county seat, and the county seat, the City of Bastrop, has adopted the 2018 IRC as part of its 2018 code family. Ask Development Services which of the two the resolution points at, and get the answer before plans are drawn. Texas licenses no general contractor, so your builder is independent and the contract is where scope, inspections and price get nailed down. Whose city rules might reach a lot outside the city?

Two city layers can land on a Bastrop County tract. The City of Bastrop requires residential permits under the International Residential Code and publishes a checklist for infill new residential construction, and it runs the 2018 IRC with the 2023 National Electric Code and the 2000 International Property Maintenance Code. It also holds subdivision authority inside the city limits and throughout its extraterritorial jurisdiction, with an interlocal agreement giving Bastrop County review of part of that. A tract well outside the city can still sit inside the city's platting reach.

The second layer is Austin's extraterritorial jurisdiction, which reaches into four counties, Bastrop among them. That is a question to ask about one address, not a rule to assume across the county. Ask the City of Bastrop and the county which layers cover your parcel before the land goes under contract, because the answer changes who reviews the plat and who you deal with on utilities. Where does the water come from, and does the aquifer program apply here?

Not the Edwards. The Edwards Aquifer Protection Program covers eight Texas counties: Kinney, Uvalde, Medina, Bexar, Comal, Hays, Travis and Williamson. Bastrop is not one of them. In a covered county like Travis, a regulated activity on the recharge zone needs an approved water pollution abatement plan before construction starts, with no acreage floor at all, and technical review of a complete application takes 90 days with no construction until approval issues. None of that arrives on a tract here, and that is the clearest scheduling difference between this county and the western end of the chain.

The major aquifer in this band of the state is the Carrizo-Wilcox, which runs from the Louisiana border to the Mexico border in a wide band next to and northwest of the Gulf Coast Aquifer. Whether it is the formation under your particular tract, and what a well into it would give you, is a question for a water well driller who has drilled nearby, not something a map answers. The other absence worth knowing is the river authority. The Lower Colorado River Authority is a septic authorized agent in Travis, Burnet and Llano counties, where its jurisdiction is the restricted and water quality zones around Lakes Buchanan, Inks, Lyndon B. Johnson, Marble Falls and Travis. So even with the Colorado River and Lake Bastrop in this county, no lake-zone permitting layer stacks on top of the county program the way it does upstream. One more water item is federal and easy to miss on a wooded tract. The construction general permit TXR150000 covers construction disturbing one acre or more, or work that is part of a larger common plan of development that will disturb one acre or more, and below one acre no coverage is required. The number to measure is the whole area you disturb, not the house footprint, and on a pine lot you should ask how clearing counts before assuming the tract stays under the line. That puts defensible space, the toad question and the stormwater threshold in one conversation, which belongs in barndominium construction planning, before pad height and drainage are drawn, not in a change order.

What is the ground like around Bastrop?

The county sits in the Post Oak Savannah, a transitional region of oak woodland patches mixed with grassland, gently rolling to hilly at 300 to 800 feet. On a barndominium lot the clay pan is the thing to find first. It decides where a storm goes once the sand above it is full, and that in turn decides where the pad sits, how the driveway culvert gets sized, and how the septic design handles water that will not go down. Two tracts on the same road can answer those differently, and the sandy surface tells you nothing about the depth of the pan beneath it. The work is soil borings and a site visit before the slab is drawn, not after the first wet spring.

Whether a tract sits inside the Lost Pines is a map question, not a look-out-the-window question. Pollen records show pines there for over 18,000 years, and the seasonally moist sandy soils of that stand are what make it critical habitat for the endangered Houston toad. So here the trees and the species question arrive together, on the same acre. That is the biggest single way a Bastrop tract differs from one at the western end of the chain, where the ground is shallow soil over limestone and the listed species is a different animal with a different answer. Settle the habitat question before a price is agreed.

What does a barndominium lot in Bastrop County run into first?

  • Sand drains and the clay pan a few feet under it does not. The pad, the driveway and the drainfield on one tract can each sit over a different depth of that pan, so get soil borings before the design rather than after the first wet spring.

  • Clearing pines for defensible space and clearing pines on a tract in Houston toad habitat are the same act with two different answers. Ask Bastrop County Development Services and the U.S. Fish and Wildlife Service before a machine goes on the lot, and get both answers in writing while the land is still under contract.

  • A pine lot brings a defensible space conversation a limestone lot up the chain does not. Texas A&M Forest Service spacing runs out to 100 feet from the house, and to 200 feet where the land allows, so the envelope you are really clearing and maintaining is far larger than the slab.

Questions people ask about Bastrop County

Does Texas license the builder?
No. Texas does not require a state license to work as a general contractor, and the Texas Residential Construction Commission was abolished with its enabling Act expiring on September 1, 2009. Local city or county requirements may still apply. So a builder here is independent, and what does the checking is your contract, your references and the three inspections the county's code standards require. State licensing attaches instead to the septic installer, licensed or registered through TCEQ, the plumber, licensed through the Texas State Board of Plumbing Examiners, and the electrician, licensed through TDLR.
