Who permits a barndominium in Bastrop, TX: the city or the county?
Start with the city limit line. Inside the City of Bastrop, the city permits residential construction under the International Residential Code and publishes a checklist for Infill Development New Residential Construction. The code in force is the 2018 International Residential Code, adopted as part of the 2018 IBC family, with the 2023 National Electric Code and the 2000 International Property Maintenance Code.
Inside those limits the city is also your septic authority. Bastrop County has exactly two on-site sewage authorized agents: Bastrop County for the entire county except the City of Bastrop, and the City of Bastrop for its city limits. The Lower Colorado River Authority, which permits septic around the lakes, has no jurisdiction here.
Outside the line the answer changes. Bastrop has subdivision authority inside the city limits and throughout its extraterritorial jurisdiction, and an interlocal agreement gives Bastrop County review of part of it, so an ETJ tract can face both city subdivision review and county development permit review. Which Bastrop County office permits the building, septic, floodplain and driveway?
In the unincorporated county a development permit covers all development, and the county counts a single-family home, a manufactured home, an RV and a tiny home as development. What inspections do barndominium builders in Bastrop, TX have to arrange?
Three inspections happen even though the county inspects nothing itself. Its Commissioners Court adopted residential building code standards by resolution on September 14, 2009, so a new house in the unincorporated county must meet the code that resolution brought in. The timing is fixed: foundation before the concrete is placed, framing and mechanical before drywall, and on completion. The builder contracts those inspections, not the county, and the inspector has to be one of six listed qualified persons.
Texas does not require a state license to work as a general contractor, and the Texas Residential Construction Commission was abolished when its enabling Act expired on September 1, 2009. Every builder you meet here is an independent builder. In Bastrop County that carries weight, because the only sign-off on your framing comes from an inspector your builder hires, not from the county. Licensed attaches to the trades instead: septic installer, electrician, plumber. Ask who they contract as the third-party inspector, and ask for the reports from their last Bastrop County house. What is under a Bastrop lot: a clay pan and Houston toad habitat?
Ask your septic designer one question before anything else: does a clay pan sit under your lot? Post Oak Savannah uplands are sands and sandy loams, bottomlands are clay or clay loams, and a dense clay pan almost impervious to water underlies all of those soil types at only a few feet deep. If it is under you, ask what it does to drainfield sizing and to drainage around the pad, and get that answer before the site plan is drawn. Bastrop County permits every septic installation regardless of acreage, setting aside the state exception for one dwelling on ten acres or more, and its minimum lot size is half an acre with a public water supply and one acre without.
The Lost Pines is over 75,000 acres of loblolly pines across parts of five counties, the westernmost stand of loblolly pine in the United States. Its seasonally moist sandy soils are critical habitat for the endangered Houston toad, federally listed since October 13, 1970. Critical habitat was designated in portions of Bastrop and Burleson counties on January 31, 1978. The county's permit list includes a Lost Pines Habitat Conservation Plan decision where the tract is in the covered area. What does the 2011 fire scar change about building near Bastrop?
The 2011 Bastrop County Complex fire covered 32,400 acres, with 75 percent of it burning at extreme fire intensity. It destroyed 1,660 homes and 36 commercial buildings and burned for 37 days. Texas A&M Forest Service defines three home ignition zones by distance: Immediate at 0 to 5 feet, Intermediate at 5 to 30 feet, and Extended at 30 to 100 feet. In the intermediate zone tree crowns should be at least 18 feet apart and the mature canopy no closer than 10 feet to the home. Settle those distances before the site plan is drawn, because they decide where the house sits and which pines come down.
Ask the insurer, in writing, what it wants to see in the immediate zone. Ask the lender how it will handle the appraisal, because where few truly comparable sales exist an appraiser may use properties that are not truly comparable if the analysis is documented.
